$1.5 billion reserve to cover Yasmin and Yaz lawsuits, causes loss in earnings

Drug giant Bayer said on its annual report at the end of February that the company experienced a drop in earnings after it placed $1.5 billion in a fund in 2012 to cover expenses related to lawsuits for the infamous contraceptive drugs Yasmin and Yaz.

Around 4,800 plaintiffs in the U.S. have claimed these contraceptives caused heart attacks, strokes, and even death due to blood clots. Bayer reportedly agreed to settle claims in the U.S. only, according to its annual report.

Bayer will also be facing investigation by the U.S. Attorney for the Eastern District of New York based on the investigation that off-label promotion of Yasmin or Yaz occurred.

A Bayer spokeswoman declined to entertain questions beyond the report.

Woman Seeks Millions from Bayer

A 22-year-old Florida woman who claims to have suffered severe side effects after taking the Yaz/Yasmin birth control medication has filed a lawsuit against Bayer.

The plaintiff said in her lawsuit that she experienced life-threatening side effects, including a bilateral pulmonary embolism, after taking Yaz. The complaint states that the woman started taking Yaz in April 2005 and took it until January 2009. Majority of Yaz cases expected to be settled by end of the year

Chief U.S. District Judge David Herndon and George Washington University Law School professor Stephen Saltzburg said today that they expect more than half of the more than 9,000 Yaz and Yasmin lawsuits to be settled by the end of the year.

So far, about 1,500 cases have been settled with the average settlement reaching $214,000. Saltzburg, experienced in multi-district litigation, says the mediation process has helped him move through cases at a consistent rate.

The Madison Record reports that Bayer has agreed to pay out more than $300 million, with the most severe cases being awarded more money.

Yasmin gets stronger warnings on labels

The labels on Bayer’s Yaz and Yasmin birth control pills are receiving stronger warnings of their dangers.

The new labels include warnings that state the drug increases a woman’s chances of experiencing blood clots by three times. These blood clots are dangerous because they can have have fatal consequences, including pulmonary embolism and deep vein thrombosis. FDA advisers voted in favor of the new labels 21-5.

Yasmin contains a man-made version of progesterone called drospirenone, which greatly increases the risk of blood clots.

Bayer AG, Germany’s largest pharmaceutical producer, has predicted the cost of settling all of its Yasmin birth control lawsuits will total around $2.65 billion.

The birth control drug has been strongly linked to blood clots that can cause heart attacks or strokes. The company is currently only settling on specific venous clot injuries such as pulmonary embolism and deep vein thrombosis.

However, the drug has also been linked with other complications that include liver tumors and cerebral hemorrhage. Birth control manufacturers have been ordered to include stronger warnings of these risks on their labels.

Bayer to pay $110 million to settle birth control lawsuits

Bayer will be paying nearly $110 million in order to settle 500 of the lawsuits filed against them that each claim that their product Yasmin or Yaz caused the increased risk of birth defects.

According to the judge in the case, the first trial was pushed back and this case was settled in mediation. The $110 million settlement will be split between 500 cases, meaning that each case will be $220,000.

Each of these lawsuits claim that the contraceptives lead to blood clots, which in turn lead to heart attacks and strokes. This settlement was made just days after the FDA announced that the warning labels on the birth control pills would be changed.

U.S. regulators add information to Yasmin warning labels

Bayer AG’s birth control pills, Yasmin and Yaz, will now feature updated information on the warning labels that claim that the pill may increase the risk of blood clots.

The U.S. Food and Drug Administration announced Tuesday that although most common birth controls increase the risk of blood clots, those that contain drospirenone, a synthetic hormone, have an increased risk of blood clots.

The FDA made this statement on the topic: “The revised drug labels will report that some epidemiologic studies reported as high as a three-fold increase in the risk of blood clots for drospirenone-containing products … whereas other epidemiological studies found no additional risk.”

Clots in blood vessels can be fatal if they travel to critical organs in the body such as the lungs. This warning label was announced after the FDA conducted their own study on the birth control and found that the blood clot risk for these pills is 10 in every 10,000.

FDA consultants may have previously worked for Bayer

A conflict of interest has arisen in the case of Yasmin and Yaz lawsuits regarding members of the committee.

It has allegedly been said that members of the Food and Drug Administration who were in favor to keep the Yasmin and Yaz on the shelves had previously worked for Bayer Pharmaceuticals or received some type of financial backing from the company.

If mediation in Yaz case cannot occur, trial will continue April 2012

Last week, a judge stated that the plaintiffs in the Yaz lawsuits would go to mediation with Bayer Pharmaceuticals in order to see if an agreement could be met in the cases revolving the claims that state oral contraceptives made by Bayer caused women serious health side effects that they were not warned about.

Evidence in the case can still be found at this time in order to provide information that may be critical to the case. The judge also stated that ‘good faith’ is being sought in the negotiation process for the case and if it can not be met, a bellwether trial will be sought in April 30, 2012.
